Fraud is usually about lie. If you hide a material fact from USCIS, that is a lie by ommision; and becomes a fraud if it was done intentionally. Changing employment while on EB GC application is a material fact and would matter much when USCIS decides on your case.
Usually, this kind of ommision is found out when the individual applies for another immigration benefit or for Naturalization.

First of all, we would like to know whether your wife is pregnant or you are trying to know all the possible option for pregnancy.
If you are trying to know the option,
1) you can choose any individual health insurance provider(like blue cross or Aetna or State Farm etc) with maternity option. They expect to have coverage for 18 months before they accept any claims on maternity.
2) Also, ensure that the health insurance provider is coverage in complete US. Some of them have coverage only in west coast or tri state or midwest etc. In case of IT job, we can relcoate anywhere in US.
If pregnant, try these options.
a) Try to change to another employer who have GROUP HEALTH INSURANCE. Group health insurance cover pre-existing condition and hence no need to worry. Take HIGH premium option so that out-of-pocket is less and your expenses are less.
b) If you cannot change the employer, visit the reasonable cost hospitals around your neighbourhood , talk to the billing staff and ask for discounts. Usually, they give 30% discounts on the total cost. Otherwise, you can talk to the management staff(or write a letter) and get around 30-40% discount.
c) Ensure that you always visit the hospital, doctors, ob/gyn who are covered under your insurance provide network. Though your wife is not covered under maternity, they will work with their network doctor to get the discounted rate. Once you get that rate, ask for additional discount. Surely, you will get around 20-30% discount.
d) Based on my experience, here are the expenses cost....
ob/gyn - around 8k (prenatal to delivery)
pediatrician - around 1k ( from child birth to 2 month)
delivery expenses - around 8k (normal delivery)
- around 18 k ( c section)
scanning expenses - around 3k( depends on the conditions - sometimes, they
expect weekly scanning during 9th month).
Govt provides financial aid provide the total house income is less than 25k which
will not work for any IT professional.
As the expenses are HIGH, join some GOOD company for atleast 2 months, get their group health insurance and then quit and come back to your original company. After you
quit that company, you can use the COBRA option and get the maternity coverage.

As the time progress, I am doing all sorts of things, like checking USCIS case status, and checking everything that can possibly give me some information. I know that it is waste of time, I know it is not good for health, I know that I will get GC when time comes, but still, my mind is tricking me to think about it. I checked all these forums until 2A.M last night. I am not having enough sleep. I am waiting for a opportunity to get rid of my desi employer. I am really getting frustrated (I am not saying that I have been waiting for GC approval desperately). I just want to share my frustration and what I have been going through. I know I am in a better position than most of other people whose priority date is not even current. I wish they never dangled a carrot in front of me. I am not sure if they disappoint me next month, but I am still keeping my hopes. Hopefully, I would get over this and have enough sleep from today.

Trust me. You would see an approval this month. Most of the people who got an LUD on their approved I-140 on 07/13/2008 are seeing their GC approved. Only uncertain people are those who hasn't seen any such light.

Sorry to hear about your personal life. If you and your wife agree for filing a divorce petition together, you can file for divorce by mutual consent in India. Both of you have to be present in the court when you file. The judge will decide on the case after a wait time of six months and you may have go back again for the final judgement. There is an one-year separation time that is required before you can file for mutually consented divorce in India. If you are already separated for more than a year, this is the best route.
If not, like some one else mentioned, you can file here but, some states like NY don't have provisions for divorce based on mutual consent or irreconcilable differences. So, it will take up to a year sometimes. It is perfectly legal and valid to get a divorce in the U.S if both of you have signed the petition and have been present at the court.
Your PD is Dec 2003 and so, you have time especially with all the projections that the EB3 quota (India) may retrogress.

I was in the same boat -stuck in DBEC upto July 20th. I just scrapped thru and filed AOS Just-in-time.
For all those stuck in BEC and missed the July 2nd- Aug 17th window, please be assured that IV has not forgotten about you. One of the items IV has always been pushing for is "ability to file AOS (I-485) when Visa number is not available".
Please remember - Not doing anything about your GC situation is not an option

Guys - why is the Hike in immigration fees conciding with strong opposition to funding of the Iraq War.....These funds may well go to Iraq....as Bush is not able to garner support for additional funding from congress.
I do not think they can use it for IRAQ. But in the past, when INS was one Department, they have used it for border control and all for deporting illegals and all other such activities.

There was a soft LUD on mine as well as on my wife's I-485 :D. Mine was filed in NSC on July 2nd 2007 and transferred to CSC for receipts and transferred back to NSC :confused:. Currently mine is not within the priority date :confused: . Not sure why there is sudden LUD this month :eek:.

But I have situation where in I need your inputs to decide.
I am working at a clients place and they willing offer me a full time position.
My Labor is approved Oct 2007 and Filed for I-140 receipt pending.
In this situation should I change my job or should I wait for I 140 to be approved or wait till I apply for I 485 , but as you know the priority dates have retrogressed for EB2 and I heard that they will be unavailable shortly.
I always wanted to get a full time right from my Masters but ended up as a consultant as I had to get my H1 done.
Please Advice!
I would suggest to wait for I-140 to be approved. Once I-140 is approved , PD belongs to you. You can then move to another employer and then restart GC and port the PD with the new employer when they file for I-140. There is a grey area where I am not sure if old employer withdraws I-140 , if you will still be able to port the PD. Some say you cannot port previous PD if previous I-140 is withdrawn due fraud or misrepresentation. Some say if its withdrawn then thats sufficient to lose the old PD no matter what the reason of withdrawl is.

Most of the times I can't get hold of anyone and when I do they keep saying that they are not ready yet! That's very helpful!
God forbid if I have to leave the country due to any emergency, what the heck will I do then?

I had to sent them shipping tracking info and eventually they found my application sitting in a drawer. Never bother to opened it till than. I had to go through some higher level rank person to get my case resolved. The customer rep. phone is always busy, never able to get a hold..
