That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.

If you look at THOMAS it actually shows that Yeas are 55 and Nays are 40
So the bill passed the voting ....
but it failed because it was ruled "out-of-order" and hence rejected ...
I dont know why it was ruled out of order ... maybe because it was attached to the defence spending bill so it was not the right place to put in this kind of amendment....
I hope that Yeas mean YES and Nay mean "NO" or I need to get my head examined

Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.

I hope both Political parties keep aside big AMNESTY issue on the side for now and then work on the common ground like the DREAM act and the EB/FB legal immigration backlogs and reforms.
Dems loosing in 2010 mid-term elections and so is lost the voice of CHC, their is some HOPE with Obama admin working with moderates to get DREAM and legal immigration reforms in place, that willl definitely help both Political Parties gaining some support amongst their constituents.
GoP's agenda is to beat Pres. Obama and they will try everything in their Power to do so and bring him down as a looser and make him 1 term President like Jimmy Carter.

1. Termlife Vs Wholelife.
Term is better than whole life. Instead of going with whole life, you can have Term + Saving account. For example, if you need $500/year for term and $2500/year for whole life. Take the Term insurnace and pay $500/year, open a saving account and deposit $2000/year ($2500 - $500).
2. You can compare the different life insurance with ratings. http://www.term4sale.com/
3. No life insurance for H1 (non-immigrant)
I have talked to WesternSouthern and Metlife agents. WS does not offer Life insurance for H1 but Metlife offer life insurance provided that insured person must be working in the same company for last five years.
4. Insurance here (US) vs India
Term insurance in India is much higher than insurance here. I got the quote here for $500/year but for the same insurance amount, the LIC cost me Rs.80,000.00
5. Hidden items
Make sure, you understand all the hidden item when you take insurance from here(US) or India. If you (owner+beneficiary) take life insurance here, the insured person stays outside the country for long time (more than six weeks) and if the insured person dies then you can't claim.

Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!
Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
You can extend your H-1B. Why is EAD your only option?

I was under the impression based on some posts I read on other websites that even if your I-485 is approved before you applied for I-485 for your spouse, you can still add her if you were married before your I-485 approval date. Can someone confirm this ?? I feel the best way to handle the situation would be to apply for the I-485 of spouse on the date the PD becomes current. Keep all documents and applications ready and file on the first date. Since visa bulletin comes out 15 days in advance its good lead time to make preparations even if the movement of date is sudden.

That's encouraging! I have lot more hurdles than the Bsc + MCA issue. My employer had filed my GC in EB3 and is now willing to refile under EB2, since I was promoted to a senior role. The company attorney though is hesitating to file under EB2, his reasons are as follows:
1. 3 + 3 degree will not be approved under EB2. ( This is in response to my question about using my Bsc + MCA. My current role requires Master's degree or Bachelor's + exp. I do not want to use the experience (9 years) gained from my current employer. So I suggested we could use my master's degree + 4+ years of experience that I have before joining my current employer. )
2. Attorney thinks Software Engineer role (EB3) and Principal Software Engineer role (EB2) are not 50% different. I agree that it is not 50% different. May not be 100%, I have been advised that one can switch back to h1b if there is a gap and one is on pending 485 - but may have to do stamping prior to start using the H1b - gurus can correct me here.

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

Is there a possibility that your previous company revoked the I140 saying that they wrongly filed your 140 and that you were not qualified based upon the labor certificate? I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?
First try to figure out what the previous company has done.
Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

No point in showing frustration. Its not our birth right. We all were well educated before we came in here. Situation changes. And system makes an adjustment. Dont blame your country( I am also from India), for no one asked us to move out. There are so many nice positions available to work for. More than 80% of us found here a better oppurtunity, because there were no competition at all in getting jobs. 1st come 1st serve.
So do not complain. They do not have any urgency to hand us over the GCs. We can only request them to do the needful on the basis of our sorry state of affairs. Again, we are still at their mecrcy.
So stop complaining. Either wait and support IV or boot out.
