hi,
my lawyers filed for AOS (for my wife and me) on july 2nd in NSC. still dont have any reciepts/ead/ap etc. i have no idea why. my i-140 was approved in TSC. i was hoping that i'd get the reciepts since everyone seems to be getting them!

Providing ability to file AOS (485) without priority dates being current is part of the IV agenda. Nobody is ignoring the plight of those who have been left behind. IV is still working for your cause.
Have patience. There's a funding drive for Recapturing going on right now. It will help you (and others) to file 485. If unused visa numbers are captured dates will become current again, and you can apply for AOS. Given that PDs will jump forward by years in every category you have a good chance of getting GC in a short period of time.
Does any body think of people who did not get a chance to file I-485 who had earlier priority date(2002-mar 2005) ?

To mailmy_gc : You are very lucky to have it on the 100th day i guess..Mine is pending 98 days and i went to local office - Newark, NJ today and they told me your file is with the IO and you are probably struck in background check - cant understand he spend 90+ days on background check alone! and i am still counting. I met atleast 3 people whose EAD is pending and expired and are counting days. I cant beleive USCIS is no ruthless and care a damn about legal immigrants.
Can anyone tell me how else i can expediate? - I already tried 2 Info pass, one service request, Letter to CIS ombustman (they did respond with rrecommendation). I havent contacted senator (does it help - if so do i just call them or go to there office?). Any input will help.

Only reason I am taking PMP course is because my company provides assistance in fees if its related to my project or helpful to company growth.
I really preferred to do MBA from college instead of PMP but due to company policy had to stick with PMP.

How come your case is assigned to IO inspite of pending NC. I saw a post which said that NC should be cleared before 485 approval. They are planning to finish NC by Feb, 09; for all applicants whose NC is pending for than 6 months.
I am stuck with NC...my PD is 09/2004...

2. Again I don't get your reasoning. How does immigration status verification ensure the security of this country ? Come up with some logical points.
Do you know that there are citizens from terror breeding countries roaming around in this country as citizens ( because they are not subject to country quota), whereas people from democratic countries like India being subject to all kinds of discrimination just because we are non-immigrants ( indirectly because we are subject to country cap) ?

This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL.
Btw if you do not support DREAM ACT than you shouldn't be on this forum...

I suspect there is more to your story than you are letting on. If you are 21 now, you would have been 19 in 2005 and well able to understand the consequences of becoming an illegal immigrant. As someone said the F1 was an option if you wanted to maintain legal status.

hi people, i read all your comments about how the IV community feels about the DREAM Act, and how you guys dont know if it will benefit the children of legal immigrants that fall into a similar situation. Well i got good news for you people, i am a staff at Massachusetts Immigrant refugee advocate coalition and we had a talk with couple of staff from senators Hagel, and senator Lugar to confirm us which version of DREAM were they doing to introduce this week which most likely could be today or tomorrow. both staff members were positive that the version that will be introduce as an amendment to the defense bill will be word by word identical to S. 774 that was introduce early this spring. what this actually means is that this version of DREAM does not discriminate legal from illegal...... just wanted to clear all that out for you guys..... thanks

Guys let's come together on this--everyone has some good points to share, from every angle. As a CP filer myself, I want to say that job stability concerns are very valid for CP filers, who are haunted by last summer's greenlight and today's major retrogression. The landscape has changed for everyone, for both queues. From personal experience of being in the BEC backlog, being too early for PERM and too late for concurrent filing, after 5 years of being in this process and seeing the further backlog ahead, yes I was willing to pick CP (even though I would be giving up my ability to work as the spouse) because it looked like things were finally moving last summer. The option was there for people to choose, and nobody knew the dates would roll back so painfully again. Equally, I also want to point out that IV IS about everyone and these marvellous efforts IV continues to put together and inspiring in all of us, are beneficial to all because the overall goal is to ease the backlog which is holding everyone back. Now that this discussion has happened we are all aware of the new problem that is facing CP filers in severly retrogressed countries. And it is better that this is brought to light as we continue forward. Please everyone, continue supporting the letter campaign and let's be united and discuss these issues with respect for one another.

All those so called "Enterpreneurs" a.k.a desi bodyshoppers...Perhaps if someone started a company that actually makes something rather than just contracting....more jobs, more value...

Hi everyone,
I read the memo in details as it directly applies to my wife's ability to work and my ability to extend H1. Here is the analysis (I have excluded L visa part). But before that, I would like to acknowledge the works of this "the" person. They dont know how much their post means to others. Thank you so much for digging this out.
1) Husband H1, wife H4 (or vice versa) in 7th year. Wife can now work on a new H1. Her H1 will be valid for a new six year period. She can start work on 1st October 2007 if this is her first H1 and is aproved.
2) If wife had old H1, and say she worked for 1 year and stopped after completing 6 years on H1+H4. She can now transfer old H1 and work for 5 more years.
3) Say, wife starts work and husband loses job. Wife is now H1 and husband is on H4 - they can continue like this till wife's H1 validity period or till the family's GC is approved.
4) Husband H1 + wife H4 in 7th year (assuming GC in progress) and leave the country and stay outside USA. Husband gets transfer back to USA OR gets a new job in USA. Husaband or wife not in any H or L status at this time. They can still use the old H1 and GC process dates to get H1 extension for old H1.
5) H1 employee worked for 2 years and left USA. At any time (not just October), he can use old H1 for transfer and continue for 4 more years OR he can opt for a new 6 year period after 1 year stay outside USA.
Other provisions are for L1/L2 (which I skipped) and for preventing fraud when a person gets H1 and parks his family in US but the person remains outside USA. The memo states that H4 members should be in USA only to accompany the H1 member (provided H1 is in USA and in valid state).

Agreed 100%. Last year I was part of this lottery system, had a genuine job offer but was not lucky enough to be selected in the lottery. I know so many people who were lucky to get thru the lottery but are still hunting for jobs.
I hope this changes....may be after Presidential elections....
