In most critical situations a person can file a lawsuit in federal court and ask court to 1) compel USCIS to process your EAD within 1-2 days and 2) enjoin DHS from going after the employer if person continues working with expired EAD. Part 2 is available only if employer wants to participate in a lawsuit. Otherwise, file it yourself, it requires the same amount of time as filing for EAD.

Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
Now only people who have studied or worked in Canada on work permit are eligible.
family based is greatly restricted unlike US where around 80 is non-skill based.
That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

I would like to point out that it is not just skilled workers from India and China that are affected.

We have members from all over the world. And as far as EB-3 is concerned the entire category retrogressed -- all countries. We feel that this is a problem that affects all highly skilled workers.
One thing to remember is that reporters take snippets from hours of interviews, and then their editors edit the article down further.

out of all useful land , I guess africa has lots of uninhabited land!, so someone would not mind selling! Its not to offend anyone. I have great respect for africans, being aware that we come from them!
Me being an indian upper class guy, and this OBC thing going on back home, I dont think I belong to that country that much, where me/my children will be discreminated against!!!

there is nothing on the N-400 form that asks how you became a resident and how long you stayed at the job.
they will only ask you at the interview.
some of us are working under very abusive circumstances and i'm sure the interviewer will understand your reasons for leaving earlier.
i think the whole fraud/stay 6 months thing is just another ploy for some employers to keep using some of us for longer.

my friends..... all suggestions/opinions I got were encouraging and guiding..... never the less I got many REDs and bad comments... but its OK.... when you post on Open Forums..... people are entitled for their opinions...... So thank you......please vote if you still haven't..... I thought about my questions even more over the weekend..... Yes. That is exactly what happens. Everytime a cut-off date advances in a certain category, a sweep is conducted of all previously submitted I-485s, and either continue their processing, or if processed far enough, approve it. If a category retrogresses, processing on the case may or may not stop, but APPROVAL IS IMPOSSIBLE if the PD is before the cut-off date.

Yes, it is exactly the same. And that means their processing STOPS before approval. The 50,001st schedule A, submitted in, say, June/July/Aug 2006, will NOT be approved until her EB2 or EB3 PD becomes current.

Well, that is what happens. For example. My PD became current with the release of the Nov 2006 bulletin (I have submitted my I-485 3 years ago, and have had 2 sets of Fingerprints taken). Processing was completed on my case over a year ago, but I could not be approved until Nov 2006, because of my PD.
If, god forbid, I am not approved in November, and EB3 retrogresses back 2 months, I will once again be stalled.

I have once again sent 6 letters by mail to 6 members, but I would like to send to more by email. Can somebody please direct me to how to get those or if you have, please paste it here so that we can start sending emails also.
We must bump up our efforts as much as we can before the Oct bulletin comes out, but EB3 needs to do better. There is not much difference between the two categories when it comes to skill EB2 or EB3. As all of you know, the system is broken. There are Masters degree holders in both categories and experienced categores in both. Not long back we saw Eb3 doing better. This is not right guys,. Lets work together.

What will you do, in EB3 shoes, if the numbers are not moving in 2-3 months. You got it. MOst of them will change to EB2, right. I will too. I am sure you can imagine the scene then. I know 8 of my 15 friends have already jumped to EB2. And I am sure they have much higher priority date than most of EB2s there. So you know what to expect. Lets ALL support for the common cause.

Are they not supposed to make sure that they have enough senators on their side to pass this bill. Whatever we have won till this point is due to the efforts of core team and people who come to this website using media/campaigns. Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
On that point (and back to the original purpose of this thread), I called up USCIS to check on the status on my "pre-adjudication". The customer service rep asked me why I had called up when my priority date was not current (!) and I explained that it was because I had only received a fingerprint notice once and that was in Dec 2007; also it was in connection with my EAD application, as I remember it...how can this be if all applications have been preadjudicated. However, I was surprised when the customer service rep informed that my fingerprints had been updated in Mar 2009 and were valid till Mar 2010! When I mentioned that I had not gone in for any fingerprinting since Dec 2007, she even questioned whether I was saying that those were not my fingerprints and someone else had posed as me!! After that I didn't feel like disputing her anymore! She also told me that my application had been "preadjudicated". Has anyone else seen this happen??
