    I wonder nobody cares now that they have got capgap relief and extended OPT. But I wonder what will happen when finally a student after 29 months of OPT apply and this would keep on accumulating. It would get very dirty and ugly for students to even reach to Green Card stage. Forget about retrogression :(

    Yes, I did use LS.

    But my motive was not to jump the line as I told my company attorney to purposefully find an LC from this year or last year. And since it was a multibillion dollar company with some xx thousand employees. They were able to find one.

    Not everyone's motives is to jump the line. I did this because I didnt want to wait another 10 years to apply for I 485.

    And on the top, dont even think that all who did LS were able to jump the line. LS involves lot of scrutiny and it was always safer to use one's own labor.

    Its so funny that some people think that people who cannot prove themselves for what ever reasons (education etc) with their own labor use LS. hehehe. This is even more riskier.

    And it was always legal to do it. And may be many people and employers misused it. Shout at those people.

    As for me, my labor was going nowhere and the company with which I worked for the past few years found an LS for me which was from last year PD and I do not regret doing it.

    And I bet, people who had an opportunity like me would do it.

    And also, THE THREAD WAS NOT OPENED WITH A TITLE "WHAT IS YOUR OPINION ABOUT LS, SHOULD IT BE BANNED". There were a number of threads on this forum where you can show these kinds of opinions. This thread was opened for a different purpose.

    And moveover LS is banned now. So dont waste your energyy but use it for some good causes IV is planning for.

    jump line by one year Right? If you own labor wasn't going anywhere why not apply for new one since your multibillion dollar company looks ready to do anything for you?

    As per the data, so far people with notice date (on 485, from NSC) before sept 1st have got their FP notices (except few people). So, I presume if someone's case transfered back to NSC from CSC before spet 1 st, he or she should expect their FP notice soon.
    Obviously, we are not going get our notices if there several people lined up with NSC notice dates before our transfer dates.

    This is just my logical conclusion, may be incorrect

    Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.

    Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...

    Question remains open:

    1. When are they going to increase the GC quota?
    2. When congress id going to do something?

    I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............


    Let me explain you in very human form: Baby is the fruit. It takes 9 months to get that fruit. To get that fruit humans put effort ( You know what I mean...). When they put effort, immediately they do not look for baby.. They wait for 9 months.. Correct.. Just apply this analogy to the struggle what we have initiated.:)

    USCIS will not look into your tax records for H1b approval. They might ask you for your previous H1b approval notices and or pay stubs but thats all. However when you go to the embassy for the stamping they might ask for tax returns.

    I would say Ontario (Ottawa or maybe Toronto) is better compared to Quebec with regards to immigrants.

    In Quebec, if you cant speak French, you are frowned upon. Yeah, yeah i can hear the Montrealers saying they speak both French and English, but the reality is that Quebec only likes people who are French. I heard some racist remarks while walking in the downtown, not uncommon. For some ignoramuses, every colored person is a "bangladeshi" and hurl racist abuses. I was very shocked to say the least...Isolated incident, but not uncommon.

    Bottomline, if you wanna life like u had in the US, better Ontario than Quebec or even BC.

    I am not sure what a_to_z_Gc is looking for more details, but I would like to now if your case was transferred from NSC to CSC and back.
    Those whose cases have transferred back to NSC have not received the FP notices. I would like to know if your case was transferred back to NSC.

    My case was transferred from NSC to CSC, and then to TSC. I guess its because my I-140 was approved by TSC. I got my FP notices from TSC.

    Lol, they can.....and they'll charge like $200/hr for everything w/o H-1s willing to be relocated at moments notice.....the industry can't afford to pay someone higher just because they are 'American' if it is not profitable for them......leads back to the original point....

    And thus you are supporting the point made by anti-H1-B lobby that H1-B visas are being used for depressing wages. And secondly, what makes you think that an "american" will charge outrageously more compared to someone equally competent on H1-B?

    From a legislative point of view, a good law should have a good underlying policy designed to serve "most" (if not all), but it also must be easy to enforce. H1-B law already has "legal" safeguards like the employee must always be paid (even if there is no project to work on), employee must not pay for the H1-B fees, etc. These stipulations are blatantly violated by software consultancies in general, and they do it because it has been proved to be very hard to catch (poor employees will say nothing in the fear of losing their job and worse, having to go back home). Thus the law is clearly not enforceable with the means available to DOL, USCIS or DOS. No doubt, there are very competent, high paid consultants on H1-B. If they were 90% of the people, we wouldn't be having this conversation. The situation in all likelihood is reversed (only a small percentage of consultants on H1-B are really competent and highly paid). Removing the privilege of H1-B from consultancies will remedy a lot of real and perception problems of H1-B at one go.

    I like the way you think.

    I hate to say it but this is starting to sound very much like an Alcoholics anonymous support group session. LOL.

    Let me jump right in!

    Get a grip guys. Life is not so bad. What you guys are worrying about is relatively trivial. The odds are heavily stacked in your favor for you to get the green card eventually, most likely within 2 yrs. I can't fathom another 2 plus years with no legislative relief. In the mean time as long as you stick to AC21 rules, you should have the courage to move jobs. Heck, with EAD, you could even move into something part time and try it out before finally deciding to commit etc. My point is you have tremendous flexibility, enjoy that.

    In the small chance things do not work out, then you have presumably had an opportunity to save enough to purchase a decent home in India(or wherever your home country may be), a car and your line of work(I'm referring to the predominantly IT folks here) is in such international demand that you will be able to earn a livable wage anywhere, including India.

    And here is the real shocker to many of you. There are millions of Americans(probably well over half) who will trade their position in life with you in a heart beat given the privilege, family and social support system, education, world view and demand you are in. Sometimes it is hard to see how blessed you actually are in this world. That is why I have taken a very grim view of people who have compared their issue to slavery etc. That only speaks to their unawareness of that practice.

    Now I know none of this is going to get you your green card tomorrow and improve your mistreatment in this needlessly ridiculous and tortuous green card journey. However I am hoping it atleast gives you some perspective.

    common guys why are you making it as bigger issue.

    All he is going to give is 2K more than normal lawyer fee, which is just a 1 dollar per year for an hourly employee. I would advice him to happily take this offer and file without any complication with employer.
    Note desi employer (consulting company) are doing us favor by applying GC, other wise where the heck they have a permanent job.

    Take it easy now and ACt after 6 months of filling 485.

    Also these days lawyers have to do Overtime to prepare documents for sudden surge of new filers.

    Ask your law firm why they are charging you so much. Below are the rates charged by my lawyer and should not be too different from what most of the others charge. If the lawyer doesn't answer, then show these numbers to your employer and lodge a strong protest with them.

    Adjustment of Status
    Principal applicant $1,000
    Dependent applicant $500

    Work Authorization Cards (each) $200
    Advance Parole Travel Documents(each)$200

    If you are working on an hourly basis, does your employer pay you when you're on the bench? If he doesn't, keep record of that and once you get your GC sue him over back wages and complain to DOL. These people don't deserve any thing better.

    filing of MTR does not give you status, once they accept it, yes you are in status again.



    yes. You are basically keeping USCIS updated with the information of an emplpoyer who is willing to hire you once you get your GC.

    How long does it usually take USCIS to accept the MTR. I am assuming if it's less than 6 months then we don't have to worry about being out of status?
