Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?
I think it's worth filing in EB2 if you can. The way spillover is working right now, EB2 India is greatly benefitted. Also whatever data someone got from USCIS (through senator inquiry), there are less EB2 India pending (~50,000) than EB3 (~70,000) until July 2007.

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

Following the rules as they are doesn't imply there's no injustice or congress can just shut shop and go home. Giving unused visas from EB1 to EB2 is just following rules as they are - just as giving preference to Non-Indian's first is. I get to meet plenty of EB1 & EB2s who are just plain retards so its not 'obvious' that they're going to 'benefit' the greater society at large though the rules were framed hoping that would be the case. Also, EB3s def. have to be labor certfied so they're not displacing anyone - the whole system is such a mess and is being abused so much that things that ought to be obvious & taken granted for have to be reiterated again & again so its just dumb to say 'EB3 is the least qualified of the three and is also the most likely candidate to displace an American'! And if theres a sudden glut in the labor force and plenty of native born well qualified work force is available, there shouldnt be anyone in the GC queue to begin with so there'd be no reason to do away with any quotas - unless one presumes people will be abusing the system all the time.

For all those filing I-140 and I-485 for the first time (I.E. No PD recapturing),
You DO NOT need to file I-140 in premium. YOu can simply file the I-485 AS-IS. Actually Right now since everyone is current ANYONE can file for the I-485 provided their Labour is approved. The only way the I-140 approval would help is with the 180 day clock after which the employer has no control over your GC application.
This is what my lawyer had told me when I had asked her last time. Now if the dates were still Retrogressed but your OLD PD was becoming CURRENT, IN THAT case you WOULD need your I-140 approved before you can file the I-485 coz at that time technically you cant file for a I-485 as without the PD recapture your PD would be today's PD and that would Not be current.

It appears form the wording in the text that, anyone who has maintained a continuous stay for at least 5 years preceding and up to the date of enactment of this bill, gets to apply for AOS and be granted permanent residence.
so with respect to EB folks, this provides GC aspirants (with 5 year stay) an immediate relief. The total quota numbers are not modified. Everything stays as is. This appears to be a one time relief to free up the choke in the system (at least for EB).

Now if this means reapplying under this section, that would mean another flood of applicants. Obviously with such a deluge, you wouldnt need a quota, the CIS system itself will take years to sort out the applicants.

I dont think this bills has anything favourable to legal immigrants... It better to apply as the other category ....
I think someone finally saw the light here.
Cant you guys see the HUGE change that this is. Get out of the whole legal-illegal pissing match. This change will make the US immigration system in line with that of the UK. You get here. You stay here for 5 years. You apply and be granted Permanent Residency. Thats it.
Will that open the floodgates? Sure they will. How will they be countered? By making it very very difficult for employers to hire foreigners. If you are already here, you are fine.
Employers who hire illegal folks will face tough sanctions. the new eVerify system will probably now be mandatory for all. That takes care of those employers who were in the Dont ask, Dont tell (not talking about the military policy towards gays here) attitude. It wont weed out everyone and there will still be some guys who will work for cash, etc but it will reduce this significantly.
Employers who abuse the H1 system will now have to do lots more to prove that they couldnt find a qualified US worker. The desi employers that everyone loves to hate will find it very hard to stay in business anymore.
The big IT companies like TCS and Patni who pay 40-50K to someone with 7 yrs of work exp (like I was) will now be forced to hire from the US market thus eliminating the chances of abuse. Unfortunately it will depress IT wages in India because these biggies will need to show some kind of cost savings to do work offshore otherwise most companies will decide to bring the work back since its just not worth it to handle the hassles of offshore work. But overall it will bring some kind of balance.
All a person now will need to do is get here and manage to hold on to some job for 5 years and you will be through.
Lets see how much of this bill actually makes it out. As far as I can see, I am prefectly fine with refiling my application under this new category. The hell with EB based green cards. USCIS can take the whole EB1-EB2-EB3 and stick it where it belongs.

All this happenned due to IV members and dedicated IV core. The president of this site IV is not a GULTI, but an Indian who donated about 60,000.00 US dollars. Yes, US $ 60K. He is also just like you and me. Never thought of divisions among immigrants: Neither Indian, Chinese, Philippines nor any origin. We have members from all over the world. The majority unfortunately is from India due to severe retrogression.
Had president of IV not donated 60,000.00, majority of us would still be struggling for spouse to work.
Please read IV's goals. Then you can comment whatever you want. Without funds, nothing can be moved. We have to lobby. That is the only option we have. IV core is also like you and me with normal jobs. They can not fly to DC every week or month for lobbying.

At PortOfEntry, CBP officers are QUESTIONING IF you are working for the sponsoring employer and many folks just switched jobs with AC-21 with no valid H1B anymore.
Questions:
1. What are the Consequences at Port of Entry on travelling with AP and NOT working for the ORIGINAL GC sponsor?
2. Can anyone share thier experience what was the outcome at Port of Entry when the answer is "NO - I am not working with sponsoring employer anymore" Were they held at Portof Entry indefinitely ?
3. What Steps can anyone take when at CBP office/Immigration Official is NOT allowing you to re-enter US on Valid AP (I-485 pending) and you are NOT working for sponsoring employer and no valid H1B?
Did you or someone you know experience such questions at POE for an advanced parole? Or are you just posing a hypothetical?
I have recently re-entered on AP and not a single question was asked. Not only that, I was not fingerprinted or photographed at the counter like a visa holder would be. I was taken to the back office where an agent entered information from my AP into the computer, stamped the AP and gave it back to me. No questions asked. Period. This was at the JFK airport in NY.
Parole is meant to grant entry to resume adjustment of status. Parole is not subject to employment, it is subject to a pending I-485.
If this is a hypothetical from you, then please shake these imaginations and live in peace and enjoy EAD and AP.
Too much thinking and too much analysis has caused this community to revert back to H1 lifestyle and they are not using EAD and AP - ONE OF THE MAIN REASONS why we were all so happy due to 485 filing.
What is the point of having an early 485 filed, if you are not going to use EAD and AP and be at mercy of consulates for restamping and be at mercy of employers who will need to sponsor you to hire you?

My interpretation: the vote was not on Cornyn's amendment; ...; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. ...About bribe and corruption if you study the history it was created out of bad politics and system as things are changing with better system it will be reversed, you will never have political system with out corruption atleast there none exist on face of the earth, I am positive about India and itz growth,
If bribery and corruption are major issues, why not start the "anti-corruption" political party? It will likely be small, but it may become the "king maker" one day and have a real influence on policy. An example is the "Action Democratique" party in Quebec. They are mainly Gen-Xers which means they are almost all under 40. After decades of seperatists and Liberals dominating Quebec, they had had enough and now they are the official opposition after ten years.
For political change in the US, we have a handicap which is that we are not citizens. (Desipite this IV seems to do well.) But as an Indian, you have much more clout in India if you organize. Use the 'net as IV does. And corruption is never popular with the people who do not benefit (most of us).

I don't think they mean to say that High tech workers are illegal. They say that their poll indicates Republican voters who earn more than $75000 would like a candidate who opposes illegal immigration. Atleast, that is the way I read it.

It is time for the high skilled immigrants here to take offense with what NUSA puts out ... here is a message that was sent to them a short while ago. We can do more. The collective intelligence, tax dollars and clout of this group of HIGH SKILLED immigrants can call the bluff on Roy Beck and his bunch of fear mongers...

Your views are an arcane throwback to the era of narrow protectionism fueled by fear, uncertainty and doubt. The world's economies are growing at a much faster rate than the US because we have failed to keep pace with the talent race and skill race. We have forgotten the great tradition of adventurism and capitalism, and instead bask in the self-avowed glory of elitist protectionism... hoping that cute scare videos and falsified statistics will deceive people from seeing what NumberUSA is what it is really about = a quest of 'racial purity'. Lets not try to fool hardworking, law abiding economic agents into believing that you stand for a moral cause greater than the collective capitalist good of the United States. Indeed, it is shameful that you should continue to pander your archaic sentiments around 'immigration control' in a land where the ONLY natural citizens are American Indians. You demean the Irish, the Italians, the Germans, the Jews, the Indians and the Chinese by painting a broad brush against 'numeric over crowding' without caring to recognize the net economic value add of these and other ethnic groups. Maybe its time for todays youth to stop fawning over Hannah M, Britney S etc and get cracking at higher education ... and maybe, just maybe, our time is better spent on being parents that can imbibe a new 'gold rush' mentality of adventure and spirit instead of fear mongering and hoping that globalization will go away :).
