Hi everyone,
I read the memo in details as it directly applies to my wife's ability to work and my ability to extend H1. Here is the analysis (I have excluded L visa part). But before that, I would like to acknowledge the works of this "the" person. They dont know how much their post means to others. Thank you so much for digging this out.
1) Husband H1, wife H4 (or vice versa) in 7th year. Wife can now work on a new H1. Her H1 will be valid for a new six year period. She can start work on 1st October 2007 if this is her first H1 and is aproved.
2) If wife had old H1, and say she worked for 1 year and stopped after completing 6 years on H1+H4. She can now transfer old H1 and work for 5 more years.
3) Say, wife starts work and husband loses job. Wife is now H1 and husband is on H4 - they can continue like this till wife's H1 validity period or till the family's GC is approved.
4) Husband H1 + wife H4 in 7th year (assuming GC in progress) and leave the country and stay outside USA. Husband gets transfer back to USA OR gets a new job in USA. Husaband or wife not in any H or L status at this time. They can still use the old H1 and GC process dates to get H1 extension for old H1.
5) H1 employee worked for 2 years and left USA. At any time (not just October), he can use old H1 for transfer and continue for 4 more years OR he can opt for a new 6 year period after 1 year stay outside USA.
Other provisions are for L1/L2 (which I skipped) and for preventing fraud when a person gets H1 and parks his family in US but the person remains outside USA. The memo states that H4 members should be in USA only to accompany the H1 member (provided H1 is in USA and in valid state).
Hope this helps to all. If you have read the memo and if you have anything to add please do so. This is probably the only positive news for H1, H4, GC this year.

IMHO "legally" exploiting the system is illegal. I don't blame the system because any system will have some flaws in them. I would rather blame people who take advantage of situations esp in scenarios like this. We all know how much time some people has waited here. We heard a story on Monday right? Have we already forgot that? IV's goals and objectives are clear on its home page. Here comes the OP, registers himself and comes up with his first post of Labor substitution and how to better himself. I don't see any thing wrong in pete getting fired up. This exact attitude is the result of 6500 members and not 25,000 or what ever.

If I was judging you I would have concluded that you support what the OP is doing and wouldn't asked you what your stand is. It depends on how you understand what I said. Those NASDAQ listed companies you were referring to might have substituted labors but I am sure they wouldn't charge X dollars for giving a better PD or deduct from payroll under some other miscellaneous stuff. I am aware of what you are talking and what OP is talking and they are not the same. I don't need to explicitly tell how desi shops work with
pre-approved labor, esp in the current situation.

I think, there is no harm in calling the cops and let them know what has happened to be on safer side. Especially when you provide them your address, Did you by any chance?
Let them investigate it and find out what is going on. If you want, you can also file a complaint with FTC for phone fraud.

You cannot change employer and keep I-140 if you have not filed I-485 yet. You will have to start the GC process anew if you change the jobs now. So wait untill you apply for I-485. Wait 180 more days after that and you are free to change jobs if your new job is same or similar to your current job.
As you started your GC just now, it's OK to switch the employer and start the GC process once again. If your new employer is ready to start GC process and ready to offer good package, go ahead and take. Don't even think about any other things. If you have to pay for your GC, you need to work on the pros,cons and expenses.
As the dates retrogressed so badly, there will not be any difference if your PD changes by couple of months.

Since lot of people go to Costco for passport photos and the specs are similar I'm using them. Photos look good the place holder for the photos shows the specifications i.e. face size and you can place the photo next to it and verify.

Whatever IV is doing fine, nobody here denies that. But here are few points which I think eveybody else is trying to convey, which somehow you don't understand:
1. This site has an open forum where not only active members of IV, but other people (cowerds, that is what you think, you out-spoken fellow) also seek advice, share their experiences and hence help each other. And mind you, because of these all people, IV and this site also get so much popular.
2. The other point is WHY YOU PUSH SO MUCH FOR HELP. I think everybody understands the efforts of IV, but let the person decide himself/herself whether he/she wants to give money, go to DC ralley or not. Help is not demanded.
3. Please mind your language. I don't know why you have so much of anger and you use abusive, disturbing language for others. Its very easy to say a F* word, but very difficult to sort out others problems in decent and graceful manner. I don't think any group like IV (CARE, CRY and hundreds of NGOs in India) will push people like you do.
4. And people like you are shame for a group like IV (please ask pappu too to confirm) who spread negativity like you did in this thread.

here is a tip for next time, never threaten and intimidate other people and think that just because they r immigrants they r weak. law protects us all equally, and anytime u threaten, when i am around, just make sure it will have a negative affect....
