This bill if and when passed would let anyone in the US apply for an AOS.
Ahead of us(i doubt it).
This is just a rebranded version of something the dems were interested last time round.

I sincerely doubt this measure passing, where anyone living in this country within the time span of 5 years can apply for permanent residency. However I seriously believe, there will be some final modifications on this bill.
Either way, we all IV members should be happy, something good is about to come for all EB members. I understand the economy is in a bad situation, however for Obama to create more jobs, high skilled immigration plays a vital role.

In the state of Mass delivery is covered by the State provided you show you don't have insurance. Millions of single moms are delivering and many are teenagers and many are w/o any insurance. Delivery is considered an emergency and you will be covered. Keep your spirits up and bear the storm.....it always gets darkest before you see light again.

I really wish all the desi companies,who get people from India,and put them on bench to find a project ,be banned. They screwed H1B, and in turn all the deserving H1B candidates.
here also they process so many H1s..... for various many people.... skills/no skills... keep them on bench.... inflate resumes....

This is not new, I was advised the same by my attorneys. I have heard "internet rumors" of people successfully filing EB-2 for job descriptions such as senior software engineer and senior systems analyst, which are normally classified as job zone 4. However, I was advised by two different law firms that this is not possible. According to both attorneys I consulted, you must get a job zone 5 classification to file EB-2. Note that "information technology manager" is job zone 5, so if you're in a senior position and supervising people (e.g., a manager or even a team lead), you may be able to obtain this classification.

Here is a post from Ron Gotcher's website which might be of interest to some of us trapped in EB3 I retrogression .

He expects visa bulletin cut off for EB3 I to jump to 2004 in coming months. No reasoning behing this though..
Ron has not made prediction specifically about India. Somebody asked Ron about filing I-485 with May 2004 PD without mentioning that (s)he was from India. So Ron probably assumed RoW. The OP later clarified that (s)he is from India and Ron hasn't replied to that. So let's wait for Ron to reply before getting excited about it.
If Ron meant EB3-I, he's probably expecting a July 2007 kind of bump, which allows a lot of people to file but results in very few approvals. This can be inferred from his statement that, "your priority date will become current, briefly, in a few months".
We EB3-I's are looking for any sign, just any sign of hope. But let's be cautious in disseminating such information further.

on the contrary, the point based system completely eliminates the need of a lawyer, with the canadian and australian system u just need to do the work urself online and the balls starts rolling then, it'll be interesting how they react to this
Maybe for the educated few (in the crowd of thousands with different eligibilities). And imagine a few millions with no or dubious papers getting on the line in next few years. Just because one can apply for PR with Canada and Australia easily, it cannot be assumed that the process would be similar for US. I do not know about Australia, but comparted to Canada, I am pretty sure there would be more people wanting to come to US and the restrictions are going to be more. Three things are inescapable here for anything to do with the feds: tax, lawyers and lawyers. Any immigration reform in which the lion's share does not go to the lawyers will not reach even the banks of Potomac.

That's why we couldn't solve all the admin related issues then. If we had significant volume, we could have had visa re-stamping done in USA and the list goes on.. Any ways, I don't mean to give numbers.. But as long as we are on the same page that volume speaks and we don't have enough at this point of time, I am good.

In effect, rather than 140K visas being issued to employed applicants, about 70K are being issued and the rest going to dependents. any thoughts?

Sameer, I am true Indian and has been waiting on this loop for more than 10 years.
It was such a shock for me on friday when I received the email so anything I typed was in a panic. so don't worry about the spell check.
Myself or attorney has not received the original letter so until then I do not have more info and I came to this forum to see if anyone had similar experience and any feedback.
I normally use murthy forum and friday when I was talking to a friend he suggested some folks here had already gone through similar situation.

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.

Well, DOS is alerting that don't expect additional rapid movement any time soon. Here is the relevant part of their warning:

Cut-off date movements in recent months have been greater than might ordinarily be expected, in an effort to maximize number use within the annual numerical limits. This has been necessary because demand being received from Citizenship and Immigration Services (CIS) Offices for adjustment of status cases has been relatively light. As these dates have advanced, however, many thousands of applicants have become eligible for processing at CIS Offices. Once number use increases significantly as CIS addresses its backlog, cut-off date movement will necessarily slow or stop. Moreover, in some categories cut-off date retrogression is a particular possibility.
The only positive thing I can take from this visa bulletin (assuming there is even a modicum of linear thought possible on the movement of dates) is that the 485 traffic for PDs between 2002 July and Jan 2003 is fairly light for EB2 India. After all they stated as much in their footnotes about anticipated movement of PDs. This can be construed as offering some hope for those from EB2 India with priority dates in early 2003 (say up to march). After all anyone in their right mind would not chance CP now with the fluidity of priority dates and the pending BEC deluge of cases, and the hordes of people hunting labour subs. etc. Basically if anyone gets the chance to file 485 they will do it lest the dates retrogress again while they are waiting for the consular interview.
So those with early 2003 dates can be hopeful now, later than march and I doubt you will be in this fiscal years quota.

This will definitely lead to a lot of noise and I am quite sure the remaining 50K visas left for recapture for yrs 2002-2004 will also be recaptured soon after the elections. I hope for the SKIL provisions but am less confident about them than I am about the Schedule A workers.

does this mean that i cannot get a 3 yr extension based on approved I-140 pp? My labor is not pending for 365 days and so I am solely depending on I-140 approval for a 3 yr extension. I am filing i-140 and i-485 concurrently before July 5...will this give me an EAD option even if 140 takes longer to get approved?

Good idea. lets do it. We need to keep the ball rolling and create awareness among public as well as law makers.
This was discussed before and I cannot find it now..but here is an extension of the degrees idea.
1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc
2. Format it into standard size (perhaps A4)
3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out. - it has to be bold, in RED, if possible across the page.
4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.
5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.
This will take a lot of coordination from all state chapter...but it is doable.
Any thoughts???

there is no employment allowed on H4. Please check with your lawyer as you might have problems with canada stamping
she has never worked on H4. The problem is that she has not worked on H1 either and I am thinking of changing her back to H4 to be safe.

the only 2 choices I see are ask employer to generate paystub and switch to H4 or else leave country and get a brand new H4 on the passport. I hope both Political parties keep aside big AMNESTY issue on the side for now and then work on the common ground like the DREAM act and the EB/FB legal immigration backlogs and reforms.
Dems loosing in 2010 mid-term elections and so is lost the voice of CHC, their is some HOPE with Obama admin working with moderates to get DREAM and legal immigration reforms in place, that willl definitely help both Political Parties gaining some support amongst their constituents.
GoP's agenda is to beat Pres. Obama and they will try everything in their Power to do so and bring him down as a looser and make him 1 term President like Jimmy Carter.
