So if he initiates H1b transfer but as you said waits with the current employer and if his transfer gets denied will that affect his current H1b?? or is he safe to continue with the current employer?

I went to USA 1 yr back by h4.h1 is approved in nov2007.If i face any queries on h1 in indian emabassy.Can i go by h4 to USA in that h1 query period.i mean without h1 stamping in query period.

If 3600 have been approved, then between 7200 and 9000 numbers have already been consumed based on an average of 2 or 2.5. Take your pick. We have only completed 4 business days in August. At this rate we'll blow through the 20,000 numbers in less than ten days. That means EB2 becomes U in Sept and it makes 2006 approvals look even more egregious.

Anyone got a generic response to an I-485 Service Request that "your case is awaiting standard security checks required for everyone who applies for this immigration benefit"?

Just got H1 7th year ext approved. Planning a trip to Chennai in Nov. Tried to get the VFS appointment and nothing is there for this year. There used to be an emergency appointment link and it's no longer there. Am I missing something?

Hello. I am wondering which is the main factor behind getting your GC independence from your employer - the 180 day test or AC21.
In other words, if you stay with your 140 employer past 180 days (from 485 filing) and he withdraws (after 180 days) will it affect your 485 process?
I know that if you change your employer after 180 days through AC21 it won't affect your 485. I was wondering does it also work if you don't use AC21 but pass the 180 day 'test'....

Take an infopass appointment or call USCIS customer service. However there is no guarantee that whatever they tell you is correct.:mad:

Usually if Primary's GC approved, RFE for dependents is minor.
When my GC is approved, my dependents get an RFE.
It is for Marriage certificate, birth certificate etc.
Lawyer want $250 for each persons to respond the rfe.
I did asked a copy from the lawyer and send the RFE reply. GC approved within 1 week.
USCIS condider each I-485 as seperate petition, not as a full family affair. My lawyer have all the details, but I think she send these documents with my package only. That is why these birth and marriage certificates are missed from my dependents file.
Lawyers make money and penalise us for their omissions also !!!!!!!!!!!!!
But they didn't admit it. But I did outsmart them with the RFE.
After one month legal aid call me for money and documents, I told them, I have GC in my hand. THANK YOU. !!!!!!!!!!

What you are talking about is an automatic visa revalidation. You can re-enter the US from Canada on an expired visa if you have a valid I-94 and h1 extension. However, if you visa stamping is denied for any reason while being in Canada, you will NOT be able to re-enter anymore. Usually, the consular officer takes away your I94 or makes a note that a visa was not issued. At that point, you need a valid, unexpired visa to re-enter the US, or you have to go to your home country for visa stamping.

Why has the second H-1 petition been pending so long? Was there an RFE? What does the USCIS on line system show?

Is AILA doing anything about it? Do they need IV member support? How do we make it clear to the USCIS and Govt that targetting H1b and the free will of the employer to hire H1b is PURE SOCIALISM and anti-capitalism. It is a sure way of destroying the capitalistic engine that is keeping the US ahead. Is US becoming a restrictive economy like China? China is moving slowly but surely out of its old ways and becoming more and more open to capitalistic policies and we are finding the US slipping slowly but surely into protectionism and more socialistic principles.
How can you protect jobs here by taking away the job of another person??
The person was hired in the first place due to a lot of economic reasons that only a capitalist would know/understand. Simply by snatching the job away from one person and attempting to give to another WILL NOT HELP.
This reactive response to unemployment will destroy whatever industry is left here. Even research is now being outsourced. Biotech/research triangles are springing up in china and India and elsewhere. Major US universities are now collaborating or setting up independent shops in India and china. Ofcourse Japan and europe is not at all behind. Where is the US left now? CRYING CRYING ABOUT H1B VISAS???? IS IMMIGRATION IS REAL CAUSE OF UNEMPLOYMENT HERE???????

If you do the paper file for which you submit all the initial evidence and supporting docs, you dont need to do finger printing.
but if you do e-file then you will have to go for finger printing.
Anytime you do your finger printing it is valid for about 15 months.
For me too I gave my finger prints in Nov 2007, but still USCIS sent me FP notification for code2 Finger printing.
by the way USCIS's RFE for me turn out to be that they dont have my code-2 finger prints in their system, so they need to know the details about my FP appointment and what's the schedule.

This is my personal expereince and their are lot of other folks who filed around the same time frame are facing the RFEs for fingerprints.
anyways i am going to respond to my RFE once i complete my biometrics on august 22nd 2008, by that time i will have the acknowledgement from the Seattle, ASC that they indeed complete my code-2 FP for the EAD purpose.

Prevailing wage is for your future job after you get your green card. Bonus is paid this year although it was for your last year work and can not be included in your last year W2 and is not necessary also. Sometimes we get paid December months salary in January of the following year and will not show up in previous year's W2.

38mm is still very much in the "normal" range for a 35mm format. The usual guidline has been that the focal length of the "normal" lens should be approx. the same as the film diagonal. If you were to crop your image to 8 x10 proportions from a 35mm image the diagonal would be 38.4mm.
