Good idea. lets do it. We need to keep the ball rolling and create awareness among public as well as law makers.
This was discussed before and I cannot find it now..but here is an extension of the degrees idea.
1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc
2. Format it into standard size (perhaps A4)
3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out. - it has to be bold, in RED, if possible across the page.
4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.
5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.
This will take a lot of coordination from all state chapter...but it is doable.
Any thoughts???

Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated. I don't understand why most of the people are ignoring this simple fact. I think we need to stop consider USCIS a mystery box, and start treating it like an organization that processes the applications in a structured way.
I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.

Guys if you compare the way people live and spend in India, I think they are more well off then we are. I know some friends here, all they do is, look for coupons. They�ll fight all day with Customer care reps for $1 extra that company charged, they don�t leave tips when they eat out and they eat out once in 6 months. Except for a Camry and a leather chair may be a better bed, what is this guy doing better than he would have done in India. Atleast there he had a �Kamwaali� who did the cleaning for his family. He had a tutor who taught his daughter. Here in US all he�s doing is cleaning bathrooms, kitchen their his children ad driving his Camry.

Take home message for us guys is this: These are the people the congress hears out first when they want to make policy changes. These are the people who were able to convince NIH to double its funding in 5 years time a couple of years back. These are the people who are now saying that there is no job and money for US-born, so first get more fundingand training for us citizens, before you get foreigners to carry out research ...
It is obvious that the issue is becoming more and more acrimonious, entangled with a lot of other issues - both political and economic. Unless the retrogressed are willing to take this to heart and put up an intense effort, in coming years the matter is going to get worse. Next few months could be the only ***healthy*** window of time to achieve a remedy for retrogression. Not only the economy is driving anti-highskillimmigration groups more vocal, we are slowly finding the pro-immigrant support base thinning out because of very bad fiscal situations.
It may be true that people would want their own to be trained and educated rather than getting highly skilled people from outside the borders. However, the question we raise is not abt getting more people from outside, but is it wise to deny PR to thousands highly educated folks who are already here and stand to loose them for a vision of educating US born people which may take several years to reap fruition, while those immigrants may decide to go elsewhere for a stabler life.

seems funny that we are suddenly discussing God in this topic. But Any of the arguments presented here definitely do not prove that God does not exist.
As for praying. If merely praying would result in me getting results why should I even pray to get a GC, I would rather just pray that I never have to work and get all the needs of this life fulfilled without any effort. Why do I even care about a GC. And everyone would have started doing that.
The idea is never that of praying but of faith. Believers can give you millions of cases when their faith resulted in a favorable result. Almost all religions alo say that the first step towards having faith is to perform your duties as well as you can. Without this, there is no point of praying. Coming to religions, most also have ways of redemption but there is no way to redeem for acts in the future as you are expected to do your best.
You may or may not have faith in God, but logically it is difficult to argue one way or the other. There is a reason why even the greatest of all philosophers have not been able to come to a conclusion.
To each his own.

So, if there are 400k pending applications and recapture can get us 215K, has anyone done some analysis on how the 215k will be divided among countries and categories?

I don't think any analysis is done. That is only going to divide the community.
Some would say preference be given to EB category benefiting EB2(I&C).
Some would say PD should be given preference predominantly benefiting EB3(I).
If they follow the current spill-over rules, as you are aware, EB category would be given preference.

I do know recently where a person who got married before his greencard approval and filed his wife's case. He got approved but then three months after his approval; his wife has been sent to local office interview. I'll let you know what the outcome of that will be.
Another person was on F-1 and went straight to greencard through Schedule A. he got married after he filed for 485. Since he didn't have any non immigrant status; he could not bring his wife here. She had to do follow to join and chennai consulate asked all sorts of questions. Tax returns, w2's, letter from employer; when he joined and when he left.
Think of it this way; were you traveling before greencard with same employer? If you were then what would have changed that all of a sudden you don't like it. It would be a more plausible excuse if you didn't travel at all before and they started to make you do it after greencard approval.

Yes, you are right....he did indeed use "passive resisitance" in South Africa. We all learned about it in school and I can remember the idea making a HUGE impact on me as a kid.

In Dec DOS will move the EB2I date to april 01, 06. And USCIS exhaust the visa number by approving the 06 cases and retrogress back to april 01, 03.
And whoever has the 03 and 04 PDs will be screwed as usual.:mad:

If that happens, it will give me a stronger reason to return to India. In fact, at times I feel that is exactly what's going to transpire. The dates probably will keep inching forward and then make a U turn somewhere and I'll be back in India much sooner. And I don't think it would be that bad considering growth opportunities back home and of course our accumulated savings which will go out of the country along with us.

Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.
