EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
And exactly how is India being discriminated? Do you have proof that they are giving India less visas than the per country limit?

I have heard that USCIS is going to bring a law. Which states that if you have used AP you have to use your EAD. Or After using if you extend your H-1B than you have to go for a visa stamping. I am confuse how true is this rumor is?

I don't think there is any way of knowing if your case is pre-adjudicated. The only way you will come to know is if you receive an RFE or an interview appointment.
Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated. I don't understand why most of the people are ignoring this simple fact. I think we need to stop consider USCIS a mystery box, and start treating it like an organization that processes the applications in a structured way.
I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.

Lot of people get stuck in the name check in AOS, and many of them wait for at least 6 months. I am wondering if someone may get stuck in namcecheck and may have to wait for months in home country while doing cp?

Interesting experiment, and I can see that is how human beings respond sometimes.
However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.
Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).
Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!
In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

The guys from Freakonomics did an experiment in a Chicago school. They said they will give $50 to all students who will get a B or higher in all their subjects. After some time they have found out that students who were getting a grade in the vicinity of B earlier have improved their grades to B level. But the students who were already well below B, actually went down in the grading; from D to E for example. You can google for the details.
In the GC saga, what we need is a B grade or above.
EB3 Mexico already has a C grade, hence he tries hard to improve himself to a B grade.
EB3I is in D grade. We more or less feel that trying hard is a waste of our time. If we try hard, we might get a C grade (means EB2I folks will get GCs :( :( ). The end result is that we go from D to E. That is what you are really seeing.
PS: despite the above generalization, I am planning to participate in the advocacy days in DC and I have already contributed to the efforts. Because human beings defy logic and what is natural to other life forms on earth.

Not sure if this helps, but this kind of thing happened to me 8 years back when my wife was pregnant. I asked my employer about insurance; he said I can continue coverage if I keep paying my premiums. Even if you have to pay a bit more than actual premium it should be better than not having at all. The other option is COBRA as some one already mentioned.
If that does not work out, call your current insurance company and ask them what are your options in the event you lose your job. You don't have to tell them that you're going to be laid off yet. As the wise say, we don't have to tell everything to the other person until it is really required to disclose. You might end up finding some facts that you probably are not aware of.

Hey Guys,
I had same suitation 2 years back. I have been to Regional DMV in Trenton they refused and then I went to Edison DMV my DL renewd for 3 months with receipt #. The Lady at desk shown me the copy of some Rule has a provison that DL can be renew based on Receipt# with employer letter.Once we get the approval we have to go DMV and renew again based on new i94date.
here are the step to follow.
1) Go to Edison DMV near Pathmark Complex( i think its middlesex complex).
2) Get a letter from Employer saying that ur been with so and so years and filed h1 extension with receipt#. ( Orginal Letter from Employer not Xerox copy). They will take the letter.
3)Orginal Recepit showing proof of H1 extension and take a couple of Xerox copies they may take one of them.
4) Passport (Orginal just in case if they ask u)
5) SSN( Orginal Just in case if they ask u).

Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.
We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!

I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(
After nearly 15 months, going by recent postings here , I was tempted to call IO to get any update on my 'pending I-485' . I happened to talk to a nice IO on my first attempt. She took some time to check on status and told me my 'name check is pending'. I told her on previous occasions / Infopass I was all the time told 'everything for me, especially name check is cleared'. She came out with an explanation---- your 2nd FP was cleared on 17 July 09 (Yes, I had 2nd FP on 7/6/09 as Ist FP in Sept 07 'expired' after 15 Mo validity) and that is why new 'name check' is initiated.
I can not believe this. If this is so, they may have to wait for 180 days even if there is nothing adverse from fbi and the dates become current.
It is very creepy.....
Please, share your thoughts if uscis require NC again and again for this never ending GC process ..
