Dude I think you are thinking too much of it. USCIS is an organization that goes by a process. If they have a pending application, they have to process it. they decided in the summer of 2007 that they will hire additional contractors and process all the pending applications so that they reach their goal of 4 months processing times of 485.
Why will they waste their resources on your $325 dollars again dude? Is the amount that high that they will reopen the case at the time of finally alloting a visa number, and spend the money/resources on reviewing the case again?
Whatever be the PD, USCIS is all set for a month processing time of 485 by Sept 2009. All cases filed before Jun of this year should have been either pre-adjudicated or denied by that date.

If DOJ agress what is being done based on country of origin is unjust, in what way can they help?
Can they ask congress to act? can they order USCIS to recapture lost visas?
DOJ does not ask congress to act. They directly give orders to executive branch that is USCIS in this case, based on their judgment..

We all admit, the we haven't served our birth land as much as we have served America. Maybe there is calling here amongst all the turmoil with getting GCs.

For all those filing I-140 and I-485 for the first time (I.E. No PD recapturing),
You DO NOT need to file I-140 in premium. YOu can simply file the I-485 AS-IS. Actually Right now since everyone is current ANYONE can file for the I-485 provided their Labour is approved. The only way the I-140 approval would help is with the 180 day clock after which the employer has no control over your GC application.
This is what my lawyer had told me when I had asked her last time. Now if the dates were still Retrogressed but your OLD PD was becoming CURRENT, IN THAT case you WOULD need your I-140 approved before you can file the I-485 coz at that time technically you cant file for a I-485 as without the PD recapture your PD would be today's PD and that would Not be current.

I think you need all of them but I am not 100 % sure..

I would like to point out that it is not just skilled workers from India and China that are affected.

We have members from all over the world. And as far as EB-3 is concerned the entire category retrogressed -- all countries. We feel that this is a problem that affects all highly skilled workers.
One thing to remember is that reporters take snippets from hours of interviews, and then their editors edit the article down further.

What is your understating on money return on whole life ins. plocy?. do you think you can cancel at anytime and get back your premium or withdraw portion of your investment?
Does anything mentioned on your link about policy surrender or money withdrawal when policy is in force? please search more and post here....
As far as I know whatever premium you pay is gone when you cancel the policy but if the policy has cash value then you get that amount.

Nobody here even comes close in identifying which are the eligibility criteria. Everybody hopes for one or the other.
Meanwhile one thing is for sure:
Every application filed after July 2nd, is filed AFTER they closed the doors oficially! How are we in the same class as the people from July 2nd ??? Just because we prepared for filing ??? Isn't that a bit weak in the eyes of the law ?

Definitely not at the place where I am working.
The place where I work, people eat burgers in the meetings and we have a very small kitchen in our floor and there is no Cafetaria as such. If I had to put up with the burger smell, I expect my co-worker to put up with my Indian food smell too...

Both Franklin and GooblyWoobly have a valid point, but let's not offend anyone on the forum. I see a trend on this forum where some people are trying to differentiate people who attended the rally and who did not. Should we divide the forum to 2 groups now? One being "attended" and the other "no show". It is totally childish... I contributed some money to IV as well since I believe in its effort, and I did not include that in my signature to say "contributed $$$". Do not take your frustration out on anyone 'cause you know other people have the same right... I am not a programmer but it is a endless loop...

What we are talking here is whether One holding 3 yr bachelors Degree from India be eligible to apply under EB-2 category after completing Masters Degree from an accredited university.
If the PERM Job description says " Masters Degree"
The cheapest place to get a masters is still in India. The IGNOU MCA costs $1000 in India, and they plan to let you take exams in the future in the US. Or maybe you could do everything online and just visit to take the exam.
MKU, another well known online university has a US branch. I heard an MS is less than $2000.
Both these are generally recognized in the US
