You don't need to worry.
Your PD will be current in Oct or Nov for sure. With the current way of USCIS handling visas, there will be no big retrogress or big advance. Oct bulletin will stay the same or move forward.

Hello all,
Here is my status
I am currently using H1(3 year extension since I140 was filed) and wife is using EAD. And I also have EAD and approved I140. I have filed for my I-485 (2005 PD) with my current company in Midwest in July 2007.
I have an offer from a company in California. Is it OK to accept the offer.
1. Does it matter if I change the geographical region
2. Also my field of work does not change. Only thing that might change is my increased roles and responsibilities and my designation for example from Senior Staff Engineer(Company X) to Principal Staff Engineer (company Y)
I would like to know if Would be in trouble or if my GC would be in trouble having waited from 1997(F1) until now.

YogKc, how did you get the temp license? which state? am I eligible for temp licese at PA if I did not get the license before the current one expires..
Seems like MOtor Vechile dept is fianlly caught up with the Retrogression. I have been driving with Temp DL past 5 months. I was thinking it was the random check but this thread makes sense to me now

Well my story isn't really as bad some of the stories described here but the last 4 years of waiting for the freaking LC to clear has pretty much screwed up my wife's career. There have been days of utter frustration, fight and bad days for us because of the "dependent" visa.
Its not like my job is great either. I am stuck in the same position for the last 5 years because of the freaking labor certification. Looks like I will be stuck for another couple of years. If I bail out now and leave for India it will be hard to find a suitable position because I have been unable to move up because of GC and at the same time my wife will have the impossible task of finding a job after 4 years of unemployment.
For this reason I am wiling to gamble at least another year or two, so that my wife can work and I can get a better job and then we can start thinking about where we really want to settle :) Gosh, never knew trying to settle in US with a GC will be so unsettling :(

LOA...means I am still employed without benefits ...at my old company.

If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.

Assuming that I got my EAD, and then my I-140 got denied for whatever reason.
What happen next? Will i be out of status? do i have to leave the country? if i'm F-1 student will i be back on F-1?

Yes.You will be out of status unless you moved into a different visa like H1B /H4 (if you time left on them and able to get in the quota) .

Mark my words : Your I-485 will get approved ultimately(unless you have comitted some kind of fraud )

If 140 is approved and dates are current most likely you will get one year extension...But sure you will get H1B extension.
I think its If pending...and labor approved 365 days before start date. I still need to check with my attorney. Also even if 140 is approved and dates are current i would not be able to extend.

You dont need an EAD, if you still have valid H1. AC21 has nothing to do with EAD. However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

Read the instructions on the I485.
You might only need a receipt notice for the I140 to file I485.
Makes sense since you can concurrent file I140 and I485 anyway.
I filed I485 two months ago, and seem to recall reading this on the instructions or elsewhere.
I would also do AOS not CP.

I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
Maybe your parents did not hug you enough when you were growing up, but that's not a justifiable reason to be jealous from these kids.
We are all born as genius, life de-genius us. Each one of us have the ability to be brilliant, it just depends how each one of us chose to spend our time. Folks who spend their time constructively are brilliant, because they have learned to ignore the negative. That's why these kids are brilliant and that's why they have the talent.
A growing child with aspirations looking for a parent to comfort and console them is not a sign of weakness, its a sign of a strong bond between the child and the parent, I guess thats a cultural thing. And a strong bond with parents that takes away nothing from them for being recognized for their talent.
As far as being forced by parents is concerned, I know for fact that I would have NOT gone to University to get a degree if my parents were not there to guide me at that age. If parents use constructive guidance that allows the children to strive and become better citizens of the society, that's called "personal responsibility". Last time I check, someone became the President of this country speaking in favor of "personal responsibility" and "responsibility of parents". Was that wrong?

We haven't been able to even get 12,000 in donations yet for advocacy days...
Next time someone questions IV's efforts, I am going to bluntly ask them if they contributed or came for the advocacy day event. If they did neither, we do not need their 2 cents of free comments.

Sanju, add78 and FinalGC and others...great points...Thanks for sharing your thoughts. I am in similar boat as the OP. Its just that I already ventured out and now I am working as an independent contractor. I have a layer to go through between the Client and my employer (Desi).
Big consulting firms could charge 180, 200, even 250 to the client depending on the market rates for the particular skill set. Like most of you all mentioned, they do because like you, they want to make money as well. They have a bigger obligation of making their stakeholders happy. They do lot more than an average independent contractor do. They establish contacts mostly not at the middle manager level, but at the CEO level. As a CEO/CIO of Deloitte/IBM they have better access to CEO/CIO of the client. As it is pretty obvious, CEO/CIOs of the clients actually make/break decisions. So they are generally more successful getting big dollar projects. Once they secure a project, they obviously tend to place their employees on to the projects. Occasionally, they also hire sub-contractors AKA independent consultants when they don’t have enough internal resources.
I am looking for ways to be a successful independent contractor. I believe, networking and building a reliable set of people who can help you is very important. But the challenge is, it is not easy to find people who are reliable and who will ACTUALLY help you land a project. And of course it is not easy to stay in touch with everyone (at least for me).
To OP: I think you will have to decide what you want to do in your career. If company sponsored training, marketing, working on cross platforms/applications, stability, "company name on your resume", etc is important, you will have to compromise on the money. If you want to make quick money, take the plunge and jump in to independent consulting. You can potentially double your salary. You don’t have to have a G.C. to be a independent contractor. G.C./EAD certainly helps but not a requirement.Find a good desi employer who will support you and who will pay you "your share of money", find a good stable project and you are good to go. YOu can save money on taxes as well. But then the downside is, you pay for your own training, traveling and benefits.
End of the day - There are pros and cons on both sides of the world. Pick your choice, you will have to compromise on the cons.
BTW: I have to agree with Sanju on the commissions/under the table transactions that are reality in the consulting world.
